Terms of service

Article 1: Definitions
In these terms and conditions, the following terms shall have the following meanings:

Vurge: the company that offers products and/or services via its online platform.

Consumer: the natural person who does not act in the exercise of a profession or business and who enters into an agreement with Vurge.

Distance contract: an agreement concluded between Vurge and the consumer via Vurge's online platform, without a physical meeting between the two parties.

Cooling-off period: the period within which the consumer can exercise his right of withdrawal.

Digital content: data that is offered and delivered in digital form.

Durable data carrier: any means with which the consumer or Vurge can store information in a way that allows future use and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period.

Model withdrawal form: the form established by the legislator that consumers can use to make a withdrawal known.

Privacy Policy: Vurge's policy explaining how personal data is processed, as available on Vurge's website

Article 3: Applicability
1. These general terms and conditions apply to every offer from Vurge and to every distance contract concluded between Vurge and the consumer.
2. The conditions are made available to the consumer in an accessible manner before the contract is concluded.
3. If specific product or service conditions apply in addition to these general terms and conditions, the consumer can invoke the provision that is most favorable to him.

Article 4: The Offer
1. Each offer contains a complete and accurate description of the products and/or services offered.
2. Images are true representations of the products and services offered.
3. Obvious mistakes or errors in the offer do not bind Vurge.

Article 5: The Agreement
1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.
2. Vurge confirms receipt of the acceptance of the offer by e-mail.
3. If the consumer can pay electronically, Vurge will take appropriate security measures.
4. Vurge can obtain information about the creditworthiness of the consumer within the legal framework and refuse an order or set special conditions on that basis.

Article 6: Compliance with the Agreement and Additional Warranty
1. Vurge guarantees that the delivered products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and usability, and the applicable legal provisions at the time of the agreement.
2. Any additional warranty provided by Vurge, its suppliers or manufacturers never limits the legal rights and claims that consumers can assert against Vurge in the event of shortcomings in the compliance with the agreement.
3. Additional warranty refers to any obligation of Vurge, its supplier, importer or manufacturer with which additional rights or claims are granted that go beyond the legal obligations in the event of a shortcoming.

Article 7: Duration transactions: Duration, Termination and Extension
1. Termination: a. The consumer can terminate an agreement for an indefinite period, which relates to the periodic delivery of products or services, at any time with a maximum notice period of one month. b. A fixed-term agreement, with periodic delivery of products or services, can be terminated by the consumer at the end of the fixed term with a maximum notice period of one month.
2. Extension: a. Fixed-term agreements cannot be tacitly extended or renewed for a fixed term. b. An exception applies to subscriptions to periodic publications, which can be tacitly extended for a maximum of three months with a notice period of one month.
3. If an agreement lasts longer than one year, the consumer can terminate it at any time after one year with a notice period of one month.

Article 8: Obligations of the Consumer during the Reflection Period
1. During the reflection period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product. The starting point here is that the consumer may only handle and inspect the product as he would be allowed to do in a shop.
2. The consumer is liable for any decrease in value resulting from handling the product that goes beyond what is permitted.
3. The consumer is not liable for any depreciation of the product if the entrepreneur has not provided him with all legally required information about the right of withdrawal before or upon conclusion of the agreement.

Article 9: Exercise of the Right of Withdrawal by the Consumer and Costs Thereof
1. If the consumer exercises his right of withdrawal, he must return the product within 14 days after notification.
2. The consumer bears the costs for returning the product, unless the product is defective or does not correspond to the order. In that case, Vurge bears the return costs.
3. Vurge will refund the purchase amount within 14 days after receipt of the return shipment.

Article 10: Obligations of the Entrepreneur in the event of Withdrawal
1. If the entrepreneur makes it possible for the consumer to notify withdrawal electronically, he will immediately send a confirmation of receipt after receiving this notification. 2. The entrepreneur will reimburse all payments made by the consumer, including any delivery costs charged by the entrepreneur for the returned product, without delay but within 14 days following the day on which the consumer reports the withdrawal. Unless the entrepreneur offers to collect the product himself, he may wait with reimbursement until he has received the product or until the consumer demonstrates that he has returned the product, whichever is earlier.
3. The entrepreneur will use the same payment method that the consumer used for reimbursement, unless the consumer agrees to another method. The reimbursement is free of charge for the consumer.
4. If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, the entrepreneur does not have to reimburse the additional costs for the more expensive method.

Article 11: Complaints procedure
1. Complaints about the performance of the agreement must be submitted to Vurge fully and clearly described within a reasonable period.
2. Vurge will provide a substantive response within 14 days of receipt of the complaint. 3. If the complaint is not resolved satisfactorily, the consumer can submit a dispute to the Thuiswinkel Disputes Committee or another competent disputes committee

Article 12: Applicable Law and Disputes
1. Agreements between Vurge and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
2. Disputes will be submitted to the competent court in the Netherlands.

Article 13: Payment
1. Payment must be made immediately upon ordering via the available payment methods on the Vurge website.
2. In the absence of timely payment, Vurge reserves the right to cancel the order.

Article 14: The Price
1. During the validity period stated in the offer, the prices of the products and/or services offered by Vurge remain unchanged, except for price changes resulting from changes in VAT rates.
2. In deviation from the previous paragraph, Vurge can offer products or services with variable prices if they are subject to market fluctuations over which Vurge has no influence. If applicable, this will be explicitly stated in the offer.
3. Price increases within 3 months after concluding the agreement are only permitted if they result from statutory regulations or provisions.
4. Price increases from 3 months after concluding the agreement are only permitted if this has been agreed in advance and: a. result from statutory regulations or provisions; or b. the consumer has the option to terminate the agreement as of the effective date of the price increase.
5. The prices of products and services stated in the offer include VAT.

Article 15: Delivery and Execution
1. Vurge takes the utmost care in processing and executing orders for products and services.
2. Delivery will take place at the address specified by the consumer when placing the order.
3. In compliance with the provisions in article 4, Vurge will execute accepted orders as soon as possible and at the latest within 30 days, unless a longer delivery period has been agreed. If an order is delayed or can only be partially executed, the consumer will be informed of this within 30 days. The consumer then has the right to terminate the agreement free of charge and to receive a possible refund.
4. After termination in accordance with the previous paragraph, Vurge will immediately refund the amounts paid by the consumer.
5. The risk of damage or loss of products lies with Vurge until the moment of delivery to the consumer or a representative designated in advance by the consumer.

Article 16: Industry guarantee
1. Vurge strives for complete customer satisfaction and complies with the applicable laws and regulations within the industry.
2. In the event of complaints or disputes, Vurge will make every effort to reach a reasonable and fair solution in consultation with the consumer.

Article 17: Additional or Deviating Provisions
Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.

Article 18: Amendment of the General Terms and Conditions Webshop Quality Mark
1. The Webshop Quality Mark Foundation will not amend these general terms and conditions other than in consultation with the Consumers' Association.
2. Amendments to these conditions will only come into effect after they have been published in an appropriate manner, with the understanding that in the event of applicable amendments during the term of an offer, the provision most favourable to the consumer will prevail.
